General Law on Ecological Balance and Environmental Protection (LGEEPA)

The General Law on Ecological Balance and Environmental Protection (Ley General del Equilibrio Ecológico y la Protección al Ambiente, LGEEPA) is Mexico's main environmental framework law. First published in 1988, it sets the legal basis for the protection, conservation, restoration and sustainable use of natural resources, and for guaranteeing the population's right to a healthy environment. Over the years it has been reformed to address emerging challenges, from air and water pollution to biodiversity loss and the effects of climate change.

What is the LGEEPA?

The LGEEPA establishes the foundations for environmental policy in Mexico. It covers areas ranging from environmental impact assessment and ecological land-use planning to the prevention and control of pollution of the atmosphere and water bodies. It also defines the powers and responsibilities of the three levels of government, federal, state and municipal, to encourage inter-institutional cooperation and better environmental governance across the country.

Main objectives

  1. Protecting ecosystems: safeguarding Mexico's biodiversity, including the creation and proper management of protected natural areas.
  2. Regulating polluting activities: setting provisions to limit air emissions, wastewater discharges and the generation of hazardous waste.
  3. Ecological land-use planning: promoting rational, balanced use of the territory to harmonise productive activities with the conservation of natural resources.
  4. Citizen participation: fostering transparency and social involvement, allowing the public to take part in processes such as environmental impact assessment.

Implications for governments and industry

The LGEEPA requires federal, state and municipal authorities to integrate sustainability criteria into their programmes and projects. Productive sectors (industry, agriculture, mining and tourism) must adjust their operations to comply with limits on emissions and discharges and to protect biodiversity and water resources. This approach regulates economic expansion without sacrificing the health of ecosystems or the quality of life of communities.

Challenges and outlook

  1. Consistent enforcement: local governments differ in their capacity to enforce the law, so strengthening training and resources is key to ensuring a minimum level of environmental protection nationwide.
  2. Climate change adaptation: the LGEEPA has incorporated provisions on resilience and the mitigation of extreme climate effects, and works alongside instruments such as the General Law on Climate Change, though integrating them across all sectoral policies remains a challenge.
  3. Circular economy: the law continues to evolve to support more sustainable production and consumption models in which recycling, reuse and waste reduction become more important.

Despite these challenges, the LGEEPA remains the cornerstone of Mexican environmental policy, kept current through successive reforms.
